General Terms and Conditions

1. Scope
These General Terms and Conditions (“Terms”) apply to all purchases made through the online store of RYE by Martin Auer (“RYE”, “we”, “us”, “our”). By placing an order through our website, you (“you”, “the customer”) agree to these Terms.
2. Products and Availability
Our online store offers a curated selection of items, including our signature 100 percent rye sourdough bread and selected spreads (“Products”). All Products are made in limited quantities and may not always be available. We may change, limit, or discontinue Products at any time without prior notice.
3. Ordering
Orders are placed exclusively through our website. Adding items to your cart does not constitute a binding order. A contract is formed when you receive an order confirmation by email. We may refuse or cancel orders, including in cases of suspected misuse, incorrect pricing, lack of availability, or if the delivery address lies outside our service area.
4. Prices and Payment
Prices are listed in USD and include applicable New York State and City sales tax. Payment must be completed using the methods offered at checkout. Orders are processed only after full payment has been received.
5. Perishable Goods, Merchandise, and Returns
Our Products are made fresh daily. All sales are final. Due to the perishable nature of our bakery items, completed orders cannot be returned, exchanged, or refunded once fulfilled.
If you receive an incorrect, damaged, or otherwise faulty order, please notify us within 48 hours of delivery or pickup by emailing hello@martinauer.com with a short description and photo. After reviewing the matter, RYE may, at its discretion, offer a refund or replacement.For non-perishable items such as merchandise, please ensure that you confirm sizes, colors, or variants before placing your order, as these items are also final sale unless they arrive damaged or incorrect.
6. Allergies and Ingredients
Ingredients are listed on our website. All Products are produced in an environment that handles gluten, nuts, seeds, and dairy. Customers with allergies should contact us before placing an order.
7. Intellectual Property
All content on this website, including text, images, logos, and design, is the property of RYE by Martin Auer or its affiliates. Any use, reproduction, or distribution without prior written permission is not permitted.
8. Limitation of Liability
To the fullest extent permitted by law, RYE is not liable for indirect, incidental, or consequential damages arising from your use of our Products or Services. Our liability for direct damages is limited to the total value of the order in question.
